Title: Potencialidades e Fragilidades da Lei da Alienação Parental na Efetivação de Direitos das Crianças e Adolescentes nas Varas de Família

Abstract: Esta pesquisa investigou as potencialidades e fragilidades da lei da alienação parental (12.318/2010) para a efetivação do direito à convivência familiar de crianças e adolescentes em processos de litígio de guarda. Aprovada em 26/08/2010 esta lei, objetiva responsabilizar cível e criminalmente quem pratica alguma conduta que prejudique o direito à convivência familiar de crianças e adolescentes, através de “instrumentos processuais aptos a inibir ou atenuar seus efeitos”. Contudo, desde o seu projeto, esta lei é alvo de críticas. Comissões dos Direitos Humanos e Comissões dos Direitos das Famílias têm promovido audiências públicas para debater o assunto. Em torno do objetivo geral deste trabalho, buscamos identificar no universo pesquisado, quem são os litigantes que denunciam e quem são os denunciados por suposta prática de alienação parental; quais os atos predominantemente denunciados; as respostas judicias diante da alegação de alienação parental; e as considerações de assistentes sociais que atuam em Varas de Família acerca do tema desta pesquisa. Este estudo inseriu-se numa perspectiva de pesquisa exploratória, assentou num método misto, que combina técnicas quantitativas e qualitativas e o tratamento dos resultados foi concretizado através de análise de conteúdo categorial. A pesquisa foi realizada no Tribunal de Justiça de Goiás, Brasil. Foram analisados 134 processos principalmente das naturezas de guarda e responsabilidade que tramitam ou tramitaram na 1ª Vara de Família de Aparecida de Goiânia, Goiás e foram entrevistadas 9 assistentes sociais que atuam com estes processos em comarcas situadas no estado. O percurso teórico e metodológico realizado neste estudo, nos permitiu compreender que a lei da alienação parental tem sua importância enquanto mais um dispositivo legal voltado para a garantia do direito à convivência familiar de crianças e adolescentes, todavia, é insuficiente no trato das complexidades e multiplicidades de fatores imbricados numa denúncia de alienação parental. Compreendemos ainda, que a efetivação do direito à convivência familiar de crianças e adolescentes, extrapola o poder judiciário. Nesse sentido, ressaltamos a importância de questões que perpassam a temática da alienação parental, serem trabalhadas também no âmbito do poder executivo através, principalmente, de serviços socioassistenciais que já existem voltados a recuperação e/ou fortalecimento de vínculos familiares. / This research investigated the strengths and weaknesses of the parental alienation law (12.318/2010) to ensure the fulfillment of children and adolescents’ right to family life in custody litigation processes. Approved on 08/26/2010, this law aims to hold those who practice any conduct that impairs children and adolescents’ right to family life, civilly and criminally responsible, through “procedural instruments capable of inhibiting or attenuating its effects”. However, since its draft, this law has been criticized. Human Rights Commissions and Family Rights Commissions have held public hearings to debate the issue. This study was inserted in an exploratory research perspective was based on a mixed method, combining quantitative and qualitative techniques, and the treatment of the results was carried out through categorical content analysis. The research was conducted at the Court of Justice of Goiás, Brazil. We analyzed 134 cases, mainly of the custody and responsibility nature, which are or were in progress at the 1st Family Court of Aparecida de Goiânia, Goiás and 9 social workers who work with these processes in courts located in the state were interviewed. With the general goal of this work in mind, we seek to identify within the study group, who are the litigants that file the complaints and who are those who are accused of alleged practice of parental alienation; which acts are predominantly denounced; what are the judicial responses to the allegation of parental alienation; and what are the considerations of the social workers that work in Family Courts in cases related to the subject of this research. The theoretical and methodological path taken in this study allowed us to understand that the law of parental alienation has its importance as another legal provision aimed at guaranteeing the right to family life for children and adolescents, however, it is insufficient in dealing with the complexities and multiplicities of factors imbricated in a complaint of parental alienation. We also understand that the fulfilment of the right to family life for children and adolescents goes beyond the judiciary system. Due to this, we emphasize the importance of issues related to the theme of parental alienation, and because of that, they should be also worked within the realm of executive power, mainly through existing social assistance services aimed at the recovery and/or strengthening of family ties.​
